Austria: Footballtrainer films naked players
In the October last year, a 27 year old trainer of a local Footballclub got exposed. Female players found a smartphone that stuck half out of a jacket. After closer investigations, they found out it was recording the entire time. Thus, they filmed the screen as a proof and raised a criminal charge.
But the trials were discontinued in March. A motion for continuation was declined. No consequences for the offender? The Data Protection Agency objects. At the beginning of July, the Data Protection Agency issued a fine of 11.000€ – 10.000€ fine and 1.000€ for trial costs. This marks the second largest fine in Austria since the GDPR came into force – and the largest fine against a private person.
The trainer objected at the Federal Administrative Court. He did not object against the charges, rather he objected against the big size of the fine. As a side note: This way, he doesn’t need to a public verbal trial – something he certainly wants to avoid.
