Inadmissible inspection of land register for purchase offer of building land 2
After an unknown developer submitted purchase offers for plots in a new development area, the LfDI Baden-Württemberg imposed a fine. In the process, even when asked, the property owners were not told where their data came from, especially how he had gotten the information of their ownership position.
During the course of the investigation, it was discovered that the contractor had been working with a surveyor. The latter had in 2 cases identified several hundreds of property owners without their knowledge and passed them on to the contractor. This was possible because the surveyor had permission to inspect the electronic land register in the automated retrieval procedure.
The LfDI Baden-Württemberg also imposed a fine of EUR 5,000 on the surveyor.
